GIVEAWAY TERMS AND CONDITIONS
1.Applicability:
This giveaway campaign is open to First Citizen Club members of Shopper Stop Ltd. who satisfy the minimum eligibility criteria mentioned in clause 2 below.
2.Eligibility:
Users of Shoppers Stop First Citizen Club Rewards app will automatically be considered participants in this Campaign (unless they choose to opt-out), provided they meet all of the following criteria:
1. Must be 18 years of age or above;
2. Must be a resident of India (except the state of Tamil Nadu and wherever else is prohibited by law);
3. The user must have registered in the Shoppers Stop First Citizen Club Rewards app and linked their bank Credit/Debit card;
4. The user must be a First Citizen Club member and have completed a minimum transaction of INR 5,000 (Rupees Five Thousand) through the linked bank Credit/Debit card at any location of Shoppers Stop in India (except the state of Tamil Nadu and wherever else is prohibited by law). Transactions below this amount will not be eligible for the Campaign.
5. Employees of Enigmatic Smile Rewards Private Limited (ESI), Shoppers Stop, owners of the Shoppers Stop stores and their respective officers, directors, employees, affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Campaign.
3.Agreement to the Terms and Conditions
By participating, the user agrees to be fully and unconditionally bound by these terms and conditions, and represent and warrant that they meet the eligibility requirements set forth herein. The Campaign is subject to all applicable laws of India.
4.Campaign Period:
5th February 2025 till 28th February 2025 (both days included)
5.Email Communication and Opt-Out Policy:
All the existing users will be sent an email informing them about the Campaign. If within 3 (three) days of receiving such communication the user does not communicate on supportdeskindia@enigmaticsmile.com regarding their wish to opt out of participating in the Campaign, they will automatically be deemed a participant in the Campaign. The participant agrees to receive marketing and promotional emails as a condition of their entry.
6.Giveaway Prizes:
1. Eligible participants may receive an international trip for two (with valid passport) to a South East Asian country, with the following details:
- Maximum value: INR 1,50,000 per person;
- Inclusions: Round-trip, flight tickets for two adults;
- Accommodation: Any 3-star, 4-star, or 5-star hotel (subject to availability);
- Travel period: Valid from 1st April 2025 to 30th April 2025.
2. 25 eligible participants may receive couple tickets of general category to a live concert in Pune, Maharashtra.
7.Exclusions:
Any and all prize related expenses including visa fee, passport fees, taxes, commutation, travel insurance, personal expenses, or any additional expenses or customs clearances shall be the sole responsibility of the winners. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. ESI's responsibility is limited solely to sponsoring the giveaway prizes as specified above. ESI assumes no responsibility for the services provided by third parties, including but not limited to airlines, hotels, live concerts, transportation, or any other arrangements related to the event. Any issues, delays, cancellations, or disputes arising from these services must be resolved directly with the respective service providers.
8.Use of personal information:
By accepting the prize, you agree to allow Shoppers Stop and ESI to use your name, gender, portrait, photograph, voice, likeness, image, and statements for promotional and advertising purposes, without requiring additional compensation or payment.
9. Odds:
The odds of winning depend on the number of eligible entries received.
10. Winner Selection and Notification:
Winners of the Campaign will be selected under the supervision of Shoppers Stop via a lucky draw on 3rd March, 2025 and will be announced on 4th March, 2025. Winners will be notified via email, phone call and/or WhatsApp through Shoppers Stop Customer Care Associate on the registered First Citizen Club mobile number. If the user does not answer the call after 3-4 attempts, the prize will be awarded to the next eligible person. The winner once informed will need to claim the ticket/prize from the nearest Shoppers Stop Pune store. For members residing outside Pune, they must provide the address where the tickets should be sent via courier. The prize shall be claimed by 9th March, 2025, otherwise, the prize will be invalid. ESI and Shoppers Stop shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within a specified period required by ESI and Shoppers Stop on the notification email or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.
11. General Terms and Conditions:
a. These terms and conditions apply exclusively to this Campaign and do not extend to any transactions conducted by participants on the NDTV Big Bonus app, Shoppers Stop First Citizen Club Rewards app and Sarvatra Rewards app, DHONI app and any other upcoming single.id powered applications (Partner Apps);
b. This Campaign is subject to these terms and conditions. By participating, each participant confirms that they have read, understood, and agreed to be bound by these terms. Participation alone does not guarantee selection as a winner, nor should it be interpreted as a commitment by ESI and Shoppers Stop to do so. Additionally, nothing in these terms obligates ESI and Shoppers Stop to organize similar or other campaigns in the future;
c. The receipt by winner of the prize offered in this Campaign is conditioned upon compliance with any and all laws and regulations. Winners will be given the prizes on production of all documents as may be required by ESI before accepting the delivery of the prize;
d. ESI will not be responsible and liable for acceptability, suitability, delivery, service, defects, deficiency, performance, failure or quality of the products/prize provided under the Campaign;
e. Any violation of applicable laws by a winner, as determined at ESI’s sole discretion, will result in their disqualification from the campaign. All privileges and entitlements associated with being a winner will be immediately revoked;
f. ESI reserves the right to change the terms and conditions of this Campaign, including extending, withdrawing, cancelling or discontinuing or substituting the prize without notice, without assigning any reason, at its sole discretion without any liability;
g. Any attempt by a participant to deliberately damage any web site, application or undermine the legitimate operation of the Campaign may be a violation of applicable civil and criminal laws of India and should such an attempt be made, ESI reserves the right to seek damages from any such person to the fullest extent permitted by law. If the user uses fraudulent methods or otherwise attempt to circumvent the rules, they may be removed from eligibility at the sole discretion of ESI;
h. ESI reserves the right to request proof of a participant's eligibility in the event that there is a doubt over his/her eligibility for the Campaign;
i. ESI shall not be liable under or in connection with these terms and conditions or for this Campaign or for any indirect, special or consequential cost, expense, loss or damage even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and ESI and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise;
j. ESI does not accept responsibility for any technical issue, failure or malfunction that might make any user ineligible to participate in the Campaign;
k. ESI reserves the sole right to modify the terms and conditions outlined herein, as well as any other rules and regulations related to the Campaign, at any time and without prior notice, explanation, or liability. Participants are advised to review any additional terms and conditions that ESI or Shoppers Stop may communicate separately at its discretion. However, ESI is under no obligation to notify each participant individually about such changes;
l. By participating in this Campaign, the participant acknowledges and agrees that ESI, its representatives, employees, officers, directors, affiliates, licensees, successors, and assigns, shall have the right, where permitted by law, to use the participant's entry and related content without further notice, review, or consent. This includes, but is not limited to, the use of the entry, winner's name, portrait, photograph, voice, likeness, image, statements about the Campaign, and biographical information for purposes of news, publicity, advertising, public relations, trade, or promotions. Such usage may occur worldwide, in any media now known or developed in the future, in perpetuity, and without any additional compensation to the participant;
m. The participant undertakes to indemnify and keep ESI harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by ESI due to participant’s breach of any of the terms and conditions herein contained;
n. Participants are deemed to accept these terms and conditions;
o. Prizes are offered on 'NO EXCHANGE, NO REFUND' basis;
p. The decision of ESI shall be final and binding; and
q. The Campaign's goal is to effectively promote and market the Partner Apps driving awareness, engagement, and adoption.
12. Limitation of Liability:
By participating in the Campaign, each participant agrees to release, discharge, indemnify, and hold harmless ESI and Shoppers Stop and their employees, officers, directors, representatives, subsidiaries, affiliates, advertising and promotion agencies, partners, agents, successors and assigns, and their respective directors, officers, employees, and agents (collectively, the "Released Parties") from and against any claims, liabilities, damages, or losses arising out of or in connection with:
Participation: Participation in the Campaign, including but not limited to any error, omission, interruption, deletion, defect, delay in operation, transmission, communications failure, or unauthorized access to or alteration of participant entries.
Acceptance and Use of Prize:The acceptance, possession, misuse, or use of any tickets awarded in the Campaign. This includes any travel or other expenses incurred to use the prize and any incident occurring at or related to the event for which the ticket is valid.
Event Changes: The cancellation, postponement, or alteration of the event for which the tickets are issued or cancellation, postponement, or alteration of flight tickets, for any reason, including but not limited to force majeure, public health restrictions, or decisions by the event organizers, airlines or any government entity.
Technical or Human Error: Any technical or human error that may occur in the administration of the Campaign or in the processing of entries, including lost, late, misdirected, or incomplete entries.
The Released Parties shall not be responsible for any indirect, incidental, consequential, or punitive damages arising from participation in the Campaign or the use of the prize, to the maximum extent permitted by applicable law.
ESI reserves the right to cancel, modify, or suspend the Campaign at its sole discretion, without prior notice, due to circumstances beyond its control, including but not limited to fraud, technical issues, or other factors that impair the integrity or fairness of the Campaign.
13. Disputes:
The Campaign and this terms and conditions shall be governed by the laws of India. As a condition of participating in this Campaign, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be exclusively brought before a court located in Mumbai, India having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to claim any prize, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees.
14. Sponsor:
The sponsor of the Campaign is Enigmatic Smile Rewards Private Limited having its registered office at 12,13,14 F, Wework, 247 Park, LBS Marg, Vikhroli-West, Mumbai – 400079.
15.THE RESIDENTS OF THE STATE OF TAMIL NADU [AS PER TAMIL NADU PRIZE SCHEME (PROHIBITION) ACT 1979] AND WHEREVER ELSE PROHIBITED BY LAW, SHALL NOT BE ENTITLED TO PARTICIPATE IN THIS GIVEAWAY.
